Ichnaea Terms of Service

Effective date: October 2, 2026

These Terms are the agreement between you and Ichnaea for your use of the Ichnaea website and app (the "Service"). Please read them. By creating an account, paying for a plan, or using the Service, you agree to them.

Ichnaea is a general partnership between Mateo Skinner and Nekter AI LLC, a Nevada limited liability company ("Ichnaea," "we," "us").

These Terms include, by reference, our Acceptable Use and Compliance Policy, our Privacy Policy, and our Refund Policy. The Acceptable Use and Compliance Policy matters most: it covers the laws that apply when you call, text, or email anyone you find through Ichnaea.

1. Who can use Ichnaea

  • Ichnaea is for businesses only. You may not use it as a consumer or for personal, family, or household purposes.
  • You must be at least 18 and able to enter a contract.
  • If you sign up for a company, you confirm you have authority to bind that company. "You" then means the company.

2. What the Service does

When you run a search, you pick a trade and a location. Our software then:

  1. Collects publicly available business listings from Google Maps for that trade and area at that time, including each business's phone number and other listing details (such as name, address, website, rating, review count, and categories).
  2. Checks each phone number's line type (mobile, landline, VoIP, or other) through a carrier lookup provider (Telnyx).
  3. Labels each number YES (the lookup said mobile), NO (landline, VoIP, toll-free, or another non-mobile type), or UNCHECKED (not checked, for example because of daily lookup limits or a lookup error).

A "verified mobile" is a number labeled YES. Some plans also add the business owner's name where we can find it in public sources (such as state license registries, the Better Business Bureau, and the business's own website).

You can view results in the app and export them to CSV (together, "Results").

Features not yet available. Items marked "coming soon" on our pricing page (for example, a Meta Ad Library status flag) are not part of your plan until we release them. Click-to-call is switched off during the beta.

3. This is a beta

The Service is in a limited, paid beta. That means:

  • The Service is provided "as is" and "as available." It may have bugs, slowdowns, or outages.
  • Features may change, be added, or be removed at any time.
  • We may pause or end the beta. If we end it, we will give you at least 14 days' notice where we can, and handle refunds as described in the Refund Policy.
  • If you send us feedback or ideas, we may use them without owing you anything.

4. Your account

  • Give us accurate information and keep it current.
  • Keep your password private. Only you and people in your company whom you authorize may use your login.
  • You are responsible for everything that happens under your account.
  • Tell us right away at labington1022@gmail.com if you think someone has accessed your account without permission.

5. Plans, billing, and renewal

Plans. Each plan is a monthly subscription with an allowance of verified mobiles per month:

PlanVerified mobiles per monthPrice per month (USD)
Scout2,000$49
Tracker5,000$89
Pursuit15,000$149
Hunter30,000$279
Apex50,000$399
EnterpriseCustomCustom (by separate order or invoice)

Prices do not include taxes, which you pay where they apply.

Payment. Payments run through Stripe. We never see or store your full card number. By subscribing, you authorize us (through Stripe) to charge your payment method each month.

Renewal. Your subscription renews automatically each month on your billing date until you cancel. You can cancel at any time (see the Refund Policy for how and what happens next).

Founding (beta) pricing. If you signed up with a promo code or founding price, that price applies for the first 3 months. After that, the regular price applies unless we tell you otherwise.

How the allowance works.

  • Only verified mobiles (YES) count toward your allowance. NO and UNCHECKED numbers are included in your Results for free and never count.
  • We do not deliver the same phone number to your account twice, so you are not counted twice for it.
  • Your allowance resets on the 1st of each calendar month in your account's time zone. It does not reset on your billing date.
  • Unused allowance does not roll over and has no cash value.
  • When you reach your allowance, searches pause until the next reset or until you move to a bigger plan. We never charge overage fees.
  • We may set reasonable daily limits on searches and lookups to keep the Service stable for everyone.

Failed payments. If a payment fails, your allowance drops to zero until the payment succeeds.

Plan changes. During the beta, email labington1022@gmail.com to upgrade or downgrade so we can make the change without billing you for two plans at once.

Price changes. We will give you at least 30 days' notice before a price increase. It takes effect at your next renewal after that notice. If you do not agree, you can cancel before then.

6. Data accuracy: please read

Results come from public sources and third-party lookups at a point in time. Phone numbers change owners, get ported between carriers, and get disconnected. Businesses move, close, and rename. So:

  • We do not guarantee that any number is still active, still belongs to that business, or is still a mobile.
  • A line type is accurate only as of the date it was checked. To save cost, we may reuse a line-type result for the same number from an earlier check (currently up to 180 days old), including a check run for another customer.
  • A line-type check does not tell us whether a number is in service. We do not check for disconnected numbers.
  • "Verified mobile" means a carrier lookup said the number was a mobile line. It does not mean the person has agreed to be contacted, and it does not mean the number is off any Do Not Call list.
  • Owner names are our best match from public sources and can be wrong or out of date.
  • If we later add a Meta ads status flag, it will mean only that we found no active Meta ads in the sources we checked as of the date shown.
  • Listing details come from Google Maps and other public sources as they appeared when collected. We do not verify them independently.

You are responsible for checking Results before relying on them.

7. Your license to use Results

What you may do. While you follow these Terms, we give you a limited, non-exclusive, non-transferable license to use Results for your own business's sales and marketing.

If you are a marketing agency, you may use Results to prospect for your own agency and to run outreach on behalf of your clients. You may not give your clients the raw Results unless we agree in writing.

What you may not do without our written permission:

  • Sell, resell, rent, license, or give away Results, in whole or in part, as raw data.
  • Publish Results or post them where others can access them.
  • Use Results to build or add to a database, list, or product that you offer to others, or that competes with Ichnaea.

Removal requests. If we tell you that a business or person has asked to be removed from our data, you must stop using that record for outreach and delete it within 10 days.

After you cancel. If you cancel normally, you may keep using Results you already exported, under these Terms and the Acceptable Use and Compliance Policy. If we end your account for misuse, you must stop using and delete all Results.

8. Your outreach is your responsibility

You decide whether, how, and when to call, text, email, or otherwise contact anyone you find through Ichnaea. You alone are responsible for making sure that outreach is legal, including under the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do Not Call Registry and state Do Not Call lists, state telemarketing laws, the CAN-SPAM Act, and carrier and A2P 10DLC texting rules. Ichnaea does not place calls, send texts, or send emails for you, and does not check whether you have consent.

You agree to follow the Acceptable Use and Compliance Policy. If you break it, we may suspend or end your account.

9. Our property

The Service, including our software, design, and the way we compile and present Results, belongs to Ichnaea. These Terms do not give you any rights in it beyond the license in Section 7. We do not claim to own public facts about businesses.

You may not copy, modify, reverse engineer, or scrape the Service, get around its limits or security, or access it by automated means except through features we provide.

We may use aggregated, de-identified information about how the Service is used to run and improve it.

10. Third-party services and sources

Results rely on third parties, including Google Maps, the Better Business Bureau, state licensing agencies, Telnyx, and Stripe. Ichnaea is not affiliated with, endorsed by, or sponsored by any of them. Do not suggest otherwise in your outreach. Their data and services can change or stop without notice, which may affect the Service.

11. Disclaimers

To the fullest extent the law allows, the Service and all Results are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that Results will be accurate or complete, or that using Ichnaea will produce any sales or business results.

12. Limitation of liability

To the fullest extent the law allows:

  • Neither Ichnaea nor its partners (Mateo Skinner and Nekter AI LLC), nor their members, managers, employees, or contractors, will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Service or these Terms, even if we were told they were possible.
  • Our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of the amount you paid us in the 3 months before the event giving rise to the claim, or $100.

These limits do not apply where the law does not allow them. They also do not limit your payment obligations or your obligations under Section 13.

13. You protect us from claims about your outreach

You will defend, indemnify, and hold harmless Ichnaea, its partners (Mateo Skinner and Nekter AI LLC), and their members, managers, employees, and contractors from and against any claims, demands, investigations, fines, penalties, damages, settlements, and costs (including reasonable attorneys' fees) that arise from or relate to:

  • any call, text message, voicemail, email, or other contact that you or anyone acting for you makes to anyone, including claims under the TCPA, the Telemarketing Sales Rule, federal or state Do Not Call rules, state telemarketing or mini-TCPA laws, the CAN-SPAM Act, or carrier rules;
  • your use of Results;
  • your breach of these Terms or the Acceptable Use and Compliance Policy; or
  • your violation of any law or of anyone else's rights.

We will tell you promptly about a claim covered by this section. You may control the defense with counsel reasonably acceptable to us, and we may take part with our own counsel at our own cost. You may not settle a claim in a way that admits fault by us or requires us to do anything without our written consent.

14. Suspension and termination

You may cancel at any time. See the Refund Policy.

We may suspend or end your account, with or without notice, if:

  • you break these Terms or the Acceptable Use and Compliance Policy;
  • your payment fails and is not fixed;
  • we receive a credible complaint, demand, or regulator inquiry about your outreach;
  • continuing would expose Ichnaea or others to legal risk or a security threat; or
  • we end the beta or the Service.

If we end your account for misuse, you are not entitled to a refund. If we end the Service for any other reason, the Refund Policy applies.

After your account ends, your access stops. We delete your account data as described in the Privacy Policy. Unless we ended your account for misuse, you have 14 days to export your Results first.

Sections 6, 7 (the restrictions and removal requests), 8, 9, 11, 12, 13, 15, and 17 survive after your account ends.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules.

Before filing any claim, please email us at labington1022@gmail.com and give us 30 days to try to resolve it informally.

Any lawsuit about these Terms or the Service must be brought only in the state or federal courts located in Prince William County, Virginia, and you and we both consent to those courts.

16. Changes to these Terms

We may update these Terms. When we do, we will post the new version here with a new effective date. If a change is material, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using the Service after a change takes effect, you accept it. If you do not agree, you can cancel.

17. General

  • Entire agreement. These Terms (with the policies linked above and any Enterprise order form) are the whole agreement between you and us about the Service. If an Enterprise order form conflicts with these Terms, the order form wins.
  • Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, sale, or reorganization, including to a company formed by our partners.
  • No waiver. If we do not enforce a right, we have not given it up.
  • Severability. If a court finds part of these Terms unenforceable, the rest stays in effect.
  • Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our providers.
  • Electronic notices. You agree we may send you notices by email to your account address or in the app.
  • Relationship. Nothing in these Terms creates a partnership, joint venture, or agency between you and us.
